The Albanian State Aid Commission has adopted a decision a guarantee given by the Government of Albania to a loan provided by German KfW Bank to the electricity transmission system operator OST for the construction of 400 kV Albania-Macedonia transmission line.
The assessment of this guarantee involved detailed legal and economic analysis which the authority undertook with the assistance of the Energy Community Secretariat. This mechanism, under Article 2 of the Energy Community Dispute Settlement Procedures, provides for a broad cooperation and assistance mechanism between national authorities and courts and the Secretariat in cases where questions concerning the interpretation or application of Energy Community law arise. The State Aid Commission came to the conclusion that the guarantee constitutes as state aid, but is compatible and therefore legitimate.
